Is a Septic Inspection Mandatory in Maine?

  • A "Certified Inspection" in Maine is necessary during property transfer if the property resides in the shoreland zone.
  • Otherwise, inspections are not mandatory throughout the state.
  • However, it is recommended to carry out an inspection whenever a property is bought or sold.
  • The level of inspection is ultimately left to consumer's discretion, they can opt for certified inspection service or other alternatives.

 

Are Septic Inspectors Required to Notify Code Enforcement in Maine?

It's conditional. Before 2023, there were no mandates for inspectors to communicate findings to local or state code enforcement. However, current regulations demand that "Certified" Inspections:

  • Submit inspection results to local code enforcement
  • Immediately report any malfunctions within the shoreland zone to the state site evaluator

 

Beyond the shoreland zone, a Certified Inspection is optional. Therefore, you can still opt for a Real Estate Septic Inspection for your personal information, which is treated as confidential and exclusive to the client.

 

Is Septic Inspection Certification Mandatory in Maine?

No.  Maines certification program is voluntary.  There are specific requirements for inspections performed under this certification, and certification is required for official shoreland zone inspections, but inspectors can also operate outside of the certified inspection program/requirements.

 

Septic Inspection vs. "Certified" Septic Inspection: What's the Difference?

Septic Inspection:

  • In Maine, professionals are permitted to provide services that align with their respective standards.
  • The complexity and cost of these services vary according to the provider and the guidelines they follow.

 

"Certified" Inspection:

  • Requires a Maine Certified Disposal System Inspector
  • Conforms to the Maine Subsurface Wastewater Disposal Rules.
  • The report is prepared using a form provided by the Maine Subsurface Unit.
  • The report must be shared with the client and filed with the local municipality.
  • Required for transactions in the shoreland zone.
